Playpool.ai - Terms of Service

These Terms of Service ("Terms") govern your access to and use of Playpool.ai (the "Service"), a web application operated by Wrong Notes Music ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age required to consent to data processing in your jurisdiction, you may only use the Service with permission from a parent or legal guardian.

2. The Service

The Service allows you to enter text prompts to generate suggested music playlists. These playlists may include track suggestions sourced from public music metadata or third-party music services (e.g., Spotify, Apple Music, YouTube).

We use AI models to interpret your prompts and suggest playlists. Playlist suggestions are generated automatically and may contain errors, inappropriate suggestions, or incomplete/inaccurate information. We do not guarantee the availability, accuracy, or quality of any suggested tracks or playlists.

The Service may integrate with third-party music platforms. Your use of those platforms is governed by their terms and privacy policies — not ours.

3. User Accounts

Some features may require you to create an account. You are responsible for keeping your login credentials secure. You must notify us immediately of any unauthorized use of your account.

You agree not to:

  • Create accounts using false information
  • Share your account with others
  • Use the Service to impersonate any person or entity

4. User Content & Prompts

You retain ownership of any text prompts you submit ("User Content").

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify (for formatting or length), and display it solely to provide and improve the Service.

You promise that your prompts do not:

  • Infringe any copyright, trademark, or other intellectual property right
  • Contain illegal, harmful, threatening, abusive, harassing, defamatory, or obscene material
  • Promote hate speech, violence, discrimination, or illegal activities

We may remove or refuse to process any prompt that violates these rules.

5. Generated Playlists & Output

Playlists and suggestions generated by the Service ("Output") are provided as-is.

You may use the Output for personal, non-commercial purposes (e.g., create a playlist in your Spotify account).

You may not:

  • Sell, redistribute, or commercially exploit the Output
  • Claim that the Output is human-authored when it was AI-generated
  • Use the Output to train competing AI models or agents

6. Prohibited Uses

You agree not to:

  • Use any robot, scraper, spider, or other automatic device to access the Service
  • Attempt to interfere with the proper working of the Service
  • Attempt to reverse-engineer, decompile, or extract the AI model or prompts
  • Use the service to generate harmful, unethical, or illegal content
  • Use the service to generate content that violates our Terms of Service or our policies
  • Use the service to generate content that violates the Terms of third parties we use, such as Spotify's Terms of Service
  • Use the service to generate spam or unsolicited commercial communications
  • Use the Service to send spam
  • Use the Service to send unsolicited commercial communications
  • Use the Service for any illegal purpose
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service
  • Overload, attack, or disrupt the Service

7. Intellectual Property

The Service, including its design, text, graphics, AI functionality, and underlying software, is owned by us or our licensors and protected by copyright, trademark, and other laws.

We grant you a limited, non-transferable license to use the Service for personal purposes in accordance with these Terms.

8. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.

PLAYLIST SUGGESTIONS MAY INCLUDE EXPLICIT, OFFENSIVE, OR INACCURATE CONTENT. USE AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $1.00 IF YOU PAID NOTHING).

10. Termination

We may suspend or terminate your access to the Service at any time, without notice and at our sole disclosure, for conduct that we believe violates these Terms or is harmful to other users or to us.

11. Changes to Terms

We may update these Terms from time to time. We will post the new version on this page and update the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict of law principles. Court of dispute is Berlin, Germany.
